问:近年来,越来越多的南非公民通过中国中介机构申请赴华从事英语教学,其中少数人因没有办妥工作许可或在华工作实际地点同申请工作地点不符等情况,被中国警方调查、拘禁甚至驱除。中方对此有何评论?
答:当前,中国和南非关系发展势头强劲,双边人员往来频繁,人文交流密切,越来越多的南非公民选择赴华经商、旅游、工作,促进了中国的开放和经济建设,中国政府对此表示欢迎。
随着中国不断扩大开放,与世界各国紧密融合。中国秉持“开放包容、互学互鉴”精神,虚心学习包括南非在内的各国先进技术和管理经验。中国政府把英语作为中小学的必修课,所有大学都开设了英语专业。如今,中国大中城市幼儿园也逐步开设英语教学,对外籍英语教师需求旺盛。去年,中国驻南非使领馆向南非公民签发1200多份工作签证,其中绝大部分为赴华从事英语教学工作。
据统计,2017年外国公民出入境中国超过5800万人次,其中约100万人赴华工作。但遗憾的是,一些外国人在中国出现了非法就业、非法滞留等问题。中国和南非一样都有着严格的出入境管理制度和签证居留政策,中国执法部门依法查处了出现的违法行为。这是法治社会的必然要求,也是各国的通行做法。我愿在此强调的是,中国的执法行动绝不是只针对南非。
借此机会,中国驻南非使馆欢迎南非朋友赴华传授英语,但必须提醒拟赴华的南非朋友认真了解并严格遵守《中华人民共和国出境入境管理法》、《外国人在中国就业管理规定》中有关外国人赴华工作规定,特别是以下几点:
1、中国用人单位须具备相应资质条件,方可聘用外国人。具体而言,用人单位必须依法注册,所聘用外国人从事的岗位应是有特殊需要,中国国内暂缺适当人选。被聘用外国人须年满18岁,身体健康,无犯罪记录,并具有从事其工作所必须的专业技能或相适应的知识水平。
2、外国公民须持中方主管部门签发的《外国人工作许可通知》到中国驻外使领馆办妥工作签证后,方可进入中国工作。
3、外国公民在华工作的实际地点、职位须与《外国人工作许可通知》相符。如,申请赴华学习、旅游的签证持有者,不得在华从事有偿服务。
4、外国公民赴华后须于30日内办理《外国人工作许可证》和工作类居留证件。

Q:According to sources, recently many South Africans have applied for jobs asEnglish teachers via agencies in China, and some of them are investigated, detainedor deported due to working without proper permits or their employers’information inconsistent with work permits. What is your comment?
A: Currently, the China-SouthAfrica relations maintain a strong momentum of development with frequent andcloser people-to-people exchanges. More and more South Africans go toChinafor business, tour or work, which helps boostChina’sopening-up drive and economic growth. The Chinese government welcomes theirvisits toChina.
China, with its commitment to further openingup, shares extensive interests with the rest of the world. In the spirit of openness,inclusiveness and mutual learning,Chinais always willing to modestly learn advanced technologies and experience inmanagement from other countries, includingSouth Africa. Therefore, theChinese government has listed the English language as the compulsory disciplineat primary and secondary schools, and every institution of higher educationprovides the course of English learning. Nowadays, many kindergartens inChina’s majorcities compete to introduce English teaching, underpinning the strong demandfor foreign English teachers. Last year, the Chinese Embassy and ConsulatesGeneral inSouth Africaissued over 1,200 work visas to the South African citizens, most of whom intendto work as English teachers there.
According to statistics, over58 million foreigners entered into or exited fromChinain 2017, and about one million of them went toChinafor work. Unfortunately, someof those foreigners work and stay illegally.China,likeSouth Africa,has a sound system of administration on entry and exit of foreigners, as wellas residence permits. The Chinese law enforcement authorities take due measuresto prevent and combat illegal immigration acts, which is essential forChina’s rule oflaw and also an international practice applied by all the countries. And Iwould like to stress that the operational activities by the Chinese governmenttarget all violators, rather than selectively targeting South Africans.
The Chinese Embassy in SouthAfrica would like to take this opportunity to welcome the South African friendsto China to teach English, but especially remind them to carefully read the Exit and Entry Administration Law of thePeople’s Republic of China and Rules forthe Administration of Employment of Foreigners in China to fully understandhow to work legally in China. The following requirements for foreigners to workinChinaare specially highlighted:
A. Chinese employers shall be legally registered, and their offersfor foreigners shall be specialized posts that comply with Chinese national regulations,when no suitable Chinese candidates are available. Foreign employees shall beaged 18 and above, in good health and without criminal record, and havenecessary professional skills and expertise.
B. Foreign applicants shall proceed to a Chinese embassy orconsulate to apply for work visas (Z or R visa) by presenting a Foreigner’sWork Permit Notice issued by Chinese competent authorities. The foreignersshall be admitted toChinafor work only upon a work visa approved and issued.
C. Work location and post shall be consistent with the informationon the Foreigner’s Work Permit Notice. For instance, the Chinese study andtourist visas holders shall not be engaged in paid employment inChina.
D. Foreign employees shall apply for a Foreigner’s Work Permit anda work-type residence permit within 30 days upon arrival inChina.
